GENERAL CONDITIONS

1. OBJECT
These General Conditions regulate the electronic purchases you make through the www.calitashoes.es website (hereinafter, the "Contract"). By pressing the "Make Payment" button at the end of the Purchase Process, you expressly accept that these General Conditions become part of said Contracts, being obliged from that moment to comply with the provisions of the same.

CRESMINA MODA, S.L., with registered office at C/ Lagasca, 135 4C , 28006 Madrid y C.I.F. número B-72881733  (hereinafter, CRESMINA MODA), is registered in the Mercantile Registry of Madrid, Volume *****, Folio ** *, Section * of the Book of Companies. For the purposes of returns, please use the address indicated in the Returns section.

CRESMINA MODA may modify these General Conditions of Purchase at any time. The modifications made will not affect, in any case, the purchases that have been made prior to the approval of said modifications, which will be governed in any case by the General Conditions in force at the time of making these other purchases. It is the customer's responsibility to know the General Purchase Conditions in force at the time of the beginning of the Purchase Process.

These General Conditions may be supplemented or modified by particular clauses or specific conditions of certain products, especially, in what may refer to the exclusion of withdrawal rights, changes or returns. Consult the product information carefully to know these particular conditions.

CRESMINA MODA sells only to individuals, if you want to buy as a legal entity, we recommend that you go to our store.

2. REGISTRATION AS A USER
Registration on the web to make a purchase is completely optional.

You can access the section of registered users with your username and password or the means that, in each case, enable www.calitashoes.es to authenticate users. Associated with your user registration, www.calitashoes.es may use cookies or other similar means that allow you to record your browsing preferences and identify you when you connect from the same computer.

Registration as a user of www.calitashoes.com is free and is not subject to any condition or consideration. You can unsubscribe as a user at any time by sending an email to info@calitashoes.com Unsubscribing as a user will entail the cancellation of your personal user data as well as the impossibility of making purchases online in the future until you return to register as a user.

3. COVERAGE OF THE OFFER AND SPECIALTIES OF PURCHASES TO THE CANARY ISLANDS, CEUTA OR MELILLA
The sale through the www.calitashoes.com website is limited to the Spanish territory, including the Peninsula, the Balearic Islands, the Canary Islands, Ceuta and Melilla. Notwithstanding the foregoing, in the case of purchases that have the Canary Islands, Ceuta or Melilla as shipping address, the customer must provide the number of their National Identity Document (DNI) during the purchase process, not being possible make purchases from these territories with a Foreigner Identification Number (NIE) or Passport.

4. QUALITY OF ELECTRONIC CONTRACTING SERVICES
CRESMINA MODA guarantees that the products that are marketed through the Portal are of the same quality and features as those that are sold in the physical establishment of CRESMINA MODA.

Calitas World has made its best efforts so that the representation of the image of the products on the Portal is as faithful as possible to reality. Notwithstanding the foregoing, some characteristics, such as colors or texture, may not be correctly appreciated from the images or may vary depending on the conditions of your monitor.

The products published on www.calitashoes.com are accompanied by the following information:

5. VALIDITY PERIOD OF THE OFFER:
Without prejudice to the provisions of the specific legislation, the offers or proposals for contracting by electronic means will be valid during the period established by www.calitashoes.es or, failing that, for as long as they remain accessible to the recipients.

6. PRODUCT AVAILABILITY:
If at the time of issuing the order, we detect that there are no stocks of any of the products included in it, we will contact you to inform you of the impossibility of supplying that item and we will proceed to manufacture said product.

PURCHASING PROCESS:
The Purchase Process consists of the following procedures: Selection of products: Browse our page and press the "Add to cart" button each time you want to add a product to the purchase. The shopping cart contains the name of the selected product, the colour, the size, the quantity and the price in euros.

Start of the purchase process: To start the purchase process, press the "Finish Purchase" button. In the event that you are not registered as a User or have not accessed as such, you will be previously requested to do so.

Verification of purchase data: Prior to selecting the payment method, you can verify your purchase data and correct any errors made in data entry. Once you have verified your details, confirm your order.

Selection of payment method: Select the payment method you prefer and press the "Make Payment" button.

At that time, the system will redirect you to the chosen payment system where you must provide all the necessary data for said means of payment. This will be the only time you will be asked for this information. At the time you provide all the necessary data and press the purchase confirmation button, the contract will be perfected for all purposes.

Purchase confirmation: Once we receive your acceptance, nac.es will issue an on-screen confirmation that you can file and that will contain the following information:

Order number.
Order date.
Summary of the products included in the purchase.
In any case, within the following 24 hours, www.calitashoes.com will issue a confirmation of the purchase by email.

Throughout the purchase process you can consult these General Purchase Conditions as well as know the final price of the selected products.

Once the purchase is confirmed, the customer may not modify or cancel the order outside the cases provided by law or in these General Conditions.

8. LIMITS ON PURCHASE AND NO RESALE OR DISTRIBUTION
This purchase channel is restricted to consumers or final recipients of the products, therefore any professional activity of reselling or distributing the purchased products is prohibited.

9. PRICE
All prices indicated on the website are referred to in euros and include VAT, except those destined for the Canary Islands, Ceuta and Melilla, which will include the corresponding taxes and tariffs in accordance with the regulations in force in each of them.

Prior to the "Make Payment" phase, you will be able to know the complete final price of your order, broken down, where appropriate, the amount of the increases or discounts applied, as well as transport costs or other additional services.

Despite the measures adopted by Calitas World to avoid errors, it may happen that the price of a product applied during the purchase is not the one offered or that the offered price displayed on the Portal is wrong. In the event that said errors are detected after the formalization of the Contract, said Contract will be null and void in accordance with current legislation and without prejudice to your rights as a consumer. Calitas World will notify you of this incident as soon as it becomes aware of it and, in the event that you have been charged any amount for said purchase, it will proceed to reimburse you immediately.

10. PAYMENT
You can make the payment of the price of the products purchased by any of the following means:

Debit or credit cards issued by Spanish financial entities of the following classes:

MasterCard.
AMEX
Wire transfer
CRESMINA MODA may have fraud control measures in place. Said measures may entail that, in certain cases, an operation that is not is determined to be fraudulent. In the event that you are affected, let us know through the means of contact provided in these General Conditions.

Also keep in mind that the providers or issuers of the means of payment used may have adopted other anti-fraud measures not controlled by calitashoes.es and that lead to the rejection of certain types of operations. CRESMINA MODA does not control nor is it responsible for the damages that may be caused by the application of the policies approved by the different providers or issuers of means of payment.

The use of a means of payment owned by a third party is prohibited except in the event that you have the express authorization of said third party, being your responsibility the proof of said authorization and assuming all damages that may occur to Calitas. World

11. INVOICE
CRESMINA MODA will send you an electronic receipt of purchase. If you wish, you can request an invoice by contacting our Customer Service within 30 days of your purchase.

12. DELIVERY
Delivery occurs at the time you receive personally or through a third party the products purchased at the address indicated for delivery.

For this purpose, it will be necessary for you to sign, or someone on your behalf, the delivery note that the transport company provides together with the product. The signature of the delivery note does not imply conformity and only serves to prove that the delivery has taken place. Therefore, it does not affect your contractual rights nor does it imply conformity with a product in poor condition. Without prejudice to your contractual and legal rights, we ask that in order to be able to process any incident related to the shipment of the merchandise, notify us within a period not exceeding 24 hours of any incident related to the shipment, such as lack or loss of any of the products purchased, damaged product, open merchandise, etc. Keep in mind that the signature of the delivery note is necessary to deliver the product, so you must make sure that other people can receive the purchase on your behalf.

Calitas World does not accept any responsibility for the reception made by another person on its behalf without due authorization when said reception is carried out correctly at the indicated place of delivery. Delivery will be made from Monday to Friday from 9 a.m. to 7 p.m. We do not deliver on Saturdays or Sundays.

The delivery entails the transfer of risk and, consequently, that the deterioration of the products, loss or theft that may occur from that moment are not the responsibility of nac.es.

In the event that delivery is not possible, CRESMINA MODA will cancel the Contract due to the impossibility of compliance and without prejudice to the claims that CRESMINA MODA may initiate in the event of intent or fault of the client.

CRESMINA MODA does not accept post office boxes as valid shipping addresses. In the event that the Contract includes an address of a post office box, the contract will not be valid and will therefore not oblige CRESMINA MODA to comply with it, which may notify said circumstance and charge back the charges made.

The approximate delivery time for the Peninsula and the Balearic Islands is 2 working days. In the case of the Canary Islands, Ceuta and Melilla, these periods can be extended to a period between 3 and 10 working days. Notwithstanding the foregoing, since compliance with said deadlines also depends on third parties, Calitas World cannot guarantee a term of less than 30 days. For the purposes of the provisions of the Consolidated Text of the General Law for the Defense of Consumers and Users approved by Royal Legislative Decree 1/2007 of November 16, the latter should be understood as the delivery date committed by Calitas World.

13. FORCE MAJEURE OR FORTUITOUS EVENT
CRESMINA MODA will not be responsible for the total non-compliance, defective fulfillment or delay in the fulfillment of any of the obligations under its charge that were caused by any event of force majeure or fortuitous event. The term obligations that may exist will be suspended in such cases during the entire period during which the situation of force majeure or fortuitous event continues, resuming the computation once said circumstance of force majeure or fortuitous event disappears.

In accordance with the provisions of article 27.3 of Law 11/1998, of July 9, on the protection of consumers in the Community of Madrid, we inform you that at the headquarters of Calita Moda there are complaint forms at your disposal. Additionally, in all our stores there are complaint forms in the name of the company that owns the establishment. Calita Moda will resolve the claims that are addressed to it as soon as possible and, in any case, before a period of one month. In the event that said claim is not resolved satisfactorily, you may access the out-of-court conflict resolution system indicated in the previous point.

15. INTEGRITY OF THE CONTRACT:
These General Conditions of Purchase and any document to which express reference is made in them (such as particular clauses or specific conditions established for certain products and properly accepted by you at the time of accepting the purchase of the same), constitute the entirety of the Contract, replacing any other agreements or pacts that the parties may have agreed to verbally or in writing prior to the execution of the Contract.

16. APPLICABLE LAW:
The Law applicable to the Contract will be the Spanish Law without prejudice to the cases in which the laws of other States could become imperatively applicable.
